Terms and Conditions

1. Agreement to Terms
By accessing or using the Boko Tech mobile application (the “App”) and the Boko Tech website (the “Website,” collectively the “Services”), you agree to be bound by these Terms and Conditions (the “Terms”). These Terms constitute a agreement between you and Boko Tech (referred to as “Boko Tech,” “we,” “us,” or “our”). If you do not agree to all of these Terms, you are expressly prohibited from using the Services and must discontinue use immediately.

2. Definitions

• Account: The user account you create to access and use the Services.
• Beneficiary: The individual who receives money transferred through the Services.
• Content: Text, graphics, images, audio, video, software, data, and other materials available through the Services.
• Payment Instrument: A valid payment method used to fund a Transaction, such as a bank account, credit card, or debit card.
• Sender: The individual who initiates a money transfer through the Services.
• Transaction: The act of sending money to a Beneficiary through the Services.

 

3. Eligibility
By using the Services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. You further represent and warrant that you are not subject to any sanctions or otherwise designated on any list of prohibited or restricted parties or owned or controlled by such parties.

4. Account Registration and Security

• To use certain features of the Services, you must register for an Account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You are responsible for maintaining the confidentiality of your Account login credentials, including your username and password. You agree to notify Boko Tech immediately of any unauthorized access to or use of your Account.
• You are solely responsible for all activities that occur under your Account, whether authorized by you or not. Boko Tech will not be liable for any loss or damage arising from your failure to comply with these security obligations.
• We reserve the right to suspend or terminate your Account at any time if we suspect any unauthorized access, fraudulent activity, or violation of these Terms.

 

5. Money Transfer Services

• Boko Tech facilitates money transfers from Senders in North America to Beneficiaries in Africa, and vice versa.
• When initiating a Transaction, you will be required to provide certain information, including the Beneficiary’s full name, address, bank account details or mobile money information, and the amount you wish to send. You are responsible for ensuring the accuracy of this information. Boko Tech will not be liable for any errors in the information you provide.
• The exchange rates applicable to your Transaction will be displayed to you before you confirm the transfer. These rates may fluctuate.
• In addition to the transfer amount, you may be charged fees for using the Services. The applicable fees will be clearly displayed to you before you confirm your Transaction.
• We reserve the right to refuse to process any Transaction at our sole discretion, including but not limited to situations where we suspect fraud, illegal activity, or a violation of these Terms or applicable laws.
• Transaction processing times may vary depending on the destination country, the receiving institution, and other factors beyond Boko Tech’s control. We will provide an estimated delivery time, but we do not guarantee delivery within that timeframe.
• You will receive a confirmation of your Transaction via email or through the App once it has been initiated. You are responsible for reviewing this confirmation and notifying us immediately of any discrepancies.

 

6. Payment Instruments

• You agree to provide valid and authorized Payment Instrument information when funding a Transaction. You represent and warrant that you have the legal right to use the Payment Instrument you provide.
• By initiating a Transaction, you authorize Boko Tech to charge your Payment Instrument for the transfer amount, applicable fees, and any other charges related to the Transaction.
• If your Payment Instrument is declined, we will notify you, and your Transaction may be delayed or canceled. You may be responsible for any fees or charges imposed by your bank or payment provider due to insufficient funds or other reasons.

 

7. Intellectual Property

• The Services and their original content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Boko Tech, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services, except as generally and ordinarily permitted through the Services according to these Terms.
• The Boko Tech name and all related names, logos, product and service names, designs, and slogans are trademarks of Boko Tech or its affiliates or licensors. You must not use such marks without the prior written permission of Boko Tech.

 

8. User Content

• The Services may allow you to submit, upload, publish, or otherwise make available content, including feedback, reviews, and comments (“User Content”).
• You retain all rights in, and are solely responsible for, the User Content you make available through the Services. By making any User Content available through the Services, you hereby grant to Boko Tech a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Services and Content to you and to other users.
• You represent and warrant that your User Content does not violate any third-party rights, including intellectual property rights, privacy rights, and publicity rights, and is not defamatory, libelous, hateful, violent, obscene, unlawful, or otherwise objectionable.
• Boko Tech may, but is not obligated to, monitor, review, or remove User Content at any time for any reason without notice.

 

9. Prohibited Conduct
You agree not to engage in any of the following prohibited activities:

• Using the Services for any illegal purpose or in violation of any applicable laws or regulations.
• Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Services.
• Using any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
• Collecting or harvesting any personally identifiable information, including account names, from the Services.
• Impersonating another person or misrepresenting your affiliation with any person or entity.
• Engaging in any fraudulent activity, including attempting to send or receive funds using stolen or unauthorized Payment Instruments or Account information.
• Using the Services to send money to yourself or to an account you control, unless explicitly permitted.
• Violating any intellectual property or other proprietary rights of Boko Tech or any third party.
• Transmitting any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
• Engaging in any conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm Boko Tech or users of the Services or expose them to liability.

 

10. Termination

• You may terminate your Account at any time by following the instructions within the App or Website. You can also email us at support@bokotech.net and requesting that we close your account. It may take up to 30 days for your account closure to be complete.
• Boko Tech may terminate or suspend your Account and access to the Services at any time, with or without cause, and without prior notice or liability. Such termination may result in the forfeiture and destruction of all information associated with your Account.
• Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

 

11. Fees and Charges

• You agree to pay all applicable fees and charges associated with your use of the money transfer services, as disclosed within the App.
• Boko Tech reserves the right to change its fees and charges at any time, with notice provided within the App or through other reasonable means.
• Currency exchange rates are subject to fluctuations and will be determined by Boko Tech or its third-party providers at the time of the transaction.

 

12. Taxes
It is your responsibility to determine what, if any, taxes apply to the payments you make or receive, and it is your responsibility to collect, report and remit the correct tax to the appropriate tax authority. Company is not responsible for determining whether taxes apply to your transaction, or for collecting, reporting or remitting any taxes arising from any transaction.

13. Limitation of Liability
To the maximum extent permitted by applicable law, Boko Tech shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your use of or inability to use the App or the money transfer services, even if Boko Tech has been advised of the possibility of such damages. This includes, but is not limited to, losses due to errors in transactions, delays in processing, or the unavailability of the App.

14. Links to Third-Party Services
The App may contain links to or integrations with third-party services. Boko Tech is not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions and privacy policies.

15. Changes to These Terms
Boko Tech reserves the right to modify or revise these Terms at any time. We will provide notice of any material changes within the App or through other reasonable means. Your continued use of the App after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates.
